Under federal law, an individual religious exemption from vaccines is valid when it is based on subjective, sincere beliefs rooted in religion but not dependent on the existence, veracity, or accurate understanding or application of denominational tenets or doctrines. Despite the subjective nature of the individual religious exemption, Catholic institutions may recognize or deny individual religious exemptions on the basis of the institution’s own religious exemptions. For example, under the doctrine of the common good, the significant risk to the community (...) presented by non-vaccinated individuals could be grounds for an institution to deny an individual’s otherwise valid religious exemption. This paper attempts to clarify the decision-making framework used by law to balance individual religious exemptions and compelling state interests, then proposes a similar decision-making framework, consistent with Catholic moral principles, for religious institutions to use when balancing individual conscience objections and compelling duties to society. BackgroundHealthcare professionals are exposed to advertisements for prescription drugs in medical journals. Such advertisements may increase prescriptions of new drugs at the expense of older treatments even when they have no added benefits, are more harmful, and are more expensive. The publication of medical advertisements therefore raises ethical questions related to editorial integrity.MethodsWe conducted a descriptive cross-sectional study of all medical advertisements published in the Journal of the Danish Medical Association in 2015. Drugs advertised 6 times or more were compared (...) with older comparators: comparative evidence of added benefit; Defined Daily Dose cost; regulatory safety announcements; and completed and ongoing post-marketing studies 3 years after advertising.ResultsWe found 158 medical advertisements for 35 prescription drugs published in 24 issues during 2015, with a median of 7 advertisements per issue. Four drug groups and 5 single drugs were advertised 6 times or more, for a total of 10 indications, and we made 14 comparisons with older treatments. We found: ‘no added benefit’ in 4 of 14 comparisons, ‘uncertain benefits’ in 7, and ‘no evidence’ in 3 comparisons. In no comparison did we find evidence of ‘substantial added benefit’ for the new drug; advertised drugs were 2 to 196 times more expensive per Defined Daily Dose; 11 safety announcements for five advertised drugs were issued compared to one announcement for one comparator drug; 20 post-marketing studies were requested for the advertised drugs versus 10 studies for the comparator drugs, and 7 studies assessed both an advertised and a comparator drug at 3 year follow-up.Conclusions and relevanceIn this cross-sectional study of medical advertisements published in the Journal of the Danish Medical Association during 2015, the most advertised drugs did not have documented substantial added benefits over older treatments, whereas they were substantially more expensive. From January 2021, the Journal of the Danish Medical Association no longer publishes medical advertisements. (shrink)

This study examines the role of executive compensation in public governance. We collect data on corruption cases that involve top-level executives in Chinese listed state-controlled firms. We find a significant positive relationship between underpayment of executives and the likelihood of an investigation into corrupt behavior. We also show that corruption is positively associated with firm performance and that the relationship between underpayment of executives and corruption is influenced by firm performance, suggesting that top managers are more likely to engage in (...) illicit behavior if they are compensated poorly while the firms under their control perform well. Finally, we find that pay-performance sensitivity decreases when top executives are involved in corruption investigations, indicating a lack of pecuniary incentives. Our empirical findings point toward an important relationship between executive compensation and corrupt behavior, thus providing valuable input to the understanding of executive pay and its effects in China’s state sector. Evoked potentials in the amplitude-time spectrum of the electroencephalogram are commonly used to assess the extent of brain responses to stimulation with noxious contact heat. The magnitude of the N- and P-waves are used as a semi-objective measure of the response to the painful stimulus: the higher the magnitude, the more painful the stimulus has been perceived. The strength of the N-P-wave response is also largely dependent on the chosen reference electrode site. The goal of this study was to examine (...) which reference technique excels both in practical and theoretical terms when analyzing noxious contact heat evoked potentials in the amplitude-time spectrum. We recruited 21 subjects. We applied seven noxious contact heat stimuli using two temperatures, 51°C, and 54°C, to each subject. During EEG analysis, we aimed to identify the referencing technique which produces the highest N-wave and P-wave amplitudes with as little artifactual influence as possible. For this purpose, we applied the following six referencing techniques: mathematically linked A1/A2, average reference, REST, AFz, Pz, and mathematically linked PO7/PO8. We evaluated how these techniques impact the N-P amplitudes of CHEPS based on our data from healthy subjects. Considering all factors, we found that mathematically linked earlobes to be the ideal referencing site to use when displaying and evaluating CHEPS in the amplitude-time spectrum. (shrink)

In this paper we consider the effect of unitarity bounds sb⩾s≡(E1+E2) cms 2 for the recently proposed types of nonderivative 4-fermion contact interactions. To this purpose we decompose the helicity amplitudes at c.m.s. into partial waves. The bounds are defined to hold for all reaction channels due to the same type of contact interaction. We find sb=τ4π/κ. Here κ is the coupling constant. The factor τ depends on the type of coupling and on the different cases to identify the fermions. (...) It ranges from 1/3 to 4. (shrink)

The article confronts Cornelius Castoriadis's philosophy of 'the imaginary institution of society' with issues of innovation in a knowledge society and outlines a new notion of innovation as creative organization. It will take a critical approach to innovation from a historical perspective of postwar systems theory and introduce Castoriadis's philosophy as an interesting option in this regard. It proceeds in four parts: (a) First, it debates the limits of the commonplace metaphor of diffusion and adoption in today's debate on innovation. (...) (b) Second, it will present aspects of Castoriadis's thought as an alternative, in particular his debate on imagination and the proto-institution of legein/teukhein — ordered action. (c) On this background it will treat a case from the Danish innovation industry, the firm Zentropa WorkZ's programme of 'Dramatic Innovation' as an interesting example of an innovation format addressing creativity. (d) In conclusion, it will briefly debate creative knowledge formation in a knowledge society by pondering relations between innovation and current science. (shrink)

According to Clifford Geertz, the purpose of anthropology is not to explain culture but to explicate it. That should cause us to rethink our relationship with machine learning. It is, we contend, perfectly possible that machine learning algorithms, which are unable to explain, and could even be unexplainable themselves, can still be of critical use in a process of explication. Thus, we report on an experiment with anthropological AI. From a dataset of 175K Facebook comments, we trained a neural network (...) to predict the emoji reaction associated with a comment and asked a group of human players to compete against the machine. We show that a) the machine can reach the same accuracy as the players, b) it fails in roughly the same ways as the players, and c) easily predictable emoji reactions tend to reflect unambiguous situations where interpretation is easy. We therefore repurpose the failures of the neural network to point us to deeper and more ambiguous situations where interpretation is hard and explication becomes both necessary and interesting. We use this experiment as a point of departure for discussing how experiences from anthropology, and in particular the tension between formalist ethnoscience and interpretive thick description, might contribute to debates about explainable AI. Merleau-Ponty hat in keiner seiner Schriften eine systematische Hermeneutik ausgearbeitet, doch finden sich in fast allen seinen Arbeiten Bemerkungen über hermeneutisch relevante Sachverhalte. Dies gilt vornehmlich für Passagen über die Erfahrung anderer Subjektivität, über die dialogische Erfahrung und über das Produzieren und Verstehen sprachlicher Äusserungen. In diesem Beitrag wird versucht, Merleau-Ponty's Auffassungen hinsichtlich der Fragen nach Sinn, Genesis und Struktur des Verstehens vorzustellen. Hierbei wird in erste Linie das Problem berücksichtigt, was sich eigentlich vollzieht, wenn man als Leser die Bekanntschaft (...) eines klassischen, bzw. ursprünglichen Werkes macht. Das Werk spricht eine neue Sprache (parole parlante, langage conquérante), die die vorgegebene Sprache (parole parlée, langage institué) neugestaltet, so wie auch die in der neuen Sprache sich niederschlagende Erfahnings- und Gedankenwelt unsere alten Gedanken auflöst und uns eine neue Sicht auf die Wirklichkeit vermittelt. Hermeneutisch relevant ist, dass der Sinn dieser parole pensante, bzw. der pensée parlante niemals vollständig gegeben ist, noch auch durch welche Auslegung dann auch je erschöpft werden kann. Das bei der Lektüre eines solchen ursprünglichen Werkes sich bildende primäre Verständnis ist als Grundlage einer sekundären Verstehensleistung anzusehen, die das Thema der Hermeneutik, insofern sie Auslegungskunst ist, darstellt. Die Rekonstruktion des ursprünglichen Sinnes eines solchen Werkes ist in den Augen Merleau-Ponty's nicht nur in ihrer Möglichkeit beschränkt, sie ist vielmehr auch nur von untergeordneter Bedeutung. Was das erste betrifft, so sieht sich jeder solcher Rekonstruktionsversuch, (der bei der Restitution des ursprünglichen Textsinnes auch die Biographie des Autors und den historischen Kontext zu berücksichtigen hat – das Werk muss ja als Antwort auf Fragen verstanden werden, die sich im Lebenszusammenhang einer Zeit gestellt haben –) mit der Tatsache konfrontiert, dass die Gedanken und Erfahrungen, die sich in einem Werk niedergeschlagen haben, häufig so sehr miteinander verwoben sind, zum andern sich im Laufe des Lebens ihres Urhebers sich verändern, dass ihre völlige Inventarisierung zu einer unmöglichen Aufgabe wird. Zudem gehört zum Sinn eines solchen Werkes auch die Wirkung, die es in der Nachwelt hervorgerufen hat. So ist der „Wahre Descartes” keine gleichsam sich selbst erhellende Ganzheit, kein absoluter Entwurf im Sinne Sartres – sondern das Ganze von Leben, Werk und Interpretationen, das niemals definitiv entziffert werden kann. Für Merleau-Ponty ist der Sinn in fortwährendem Werden begriffen. Hierin ist jedoch auch die Bedeutung der wahren Interpretation, bzw. des wahren Denkens gelegen. Wichtiger als die in sich begrenzte Möglichkeit der Rekonstruktion ist dann auch das „penser derechef”. Merleau-Ponty beruft sich ausdrücklich auf einen Gedanken von Heidegger, demzufolge der Sinn des Denkens vor allem darin gelegen ist, das noch Ungesagte und Ungedachte in einem klassischen Werk zu entfalten. In der Tat prägt dies auch die Weise, in der Merleau-Ponty mit dem Werk Husserls oder anderer Denker umgeht. Es ist Merleau-Ponty leider nicht mehr gegeben gewesen, die rudimentären Bemerkungen über die Geschichte der Philosophie, die sich in seinem letzten Werk finden, weiter auszuarbeiten, noch auch alle Konsequenzen seiner Hermeneutik zu durchdenken, in der das Fundament der Wahrheit sowohl in der Zeit lokalisiert bleibt als auch zugleich einer die Zeit überspannenden Teleologie eingefügt ist. Indem man den Katalogen der größten deutschen elektronischen Bibliotheken mit Ausgaben der Werke von Frane Petrić und einzelnen Exemplaren dieser Ausgaben bibliographische Daten entnimmt, lassen sich Ergebnisse vorlegen, die auf anderen Wegen oder mit Hilfe anderer Mittel kaum erfolgreich wären. Es bestehen ernsthafte Indizien dafür, dass sich die deutsche Petrić-Rezeption vor dem XX. Jahrhundert von anderweitigen Rezeptionen wesentlich unterscheidet. In dieser Rezeptionsphase hebt sich besonders der Einfluss von Discussiones peripateticae und Militia romana hervor. Die Ergebnisse bezüglich des Einflusses der seit (...) 1953 erschienenen Werkausgaben von Petrić unterscheiden sich in vielerlei Hinsicht von jenen, die sich aus den älteren Ausgaben seiner Werke ergeben. Dies ist eine vorläufige Fallstudie für Deutschland, die zum Vergleich Daten aus Großbritannien und der AHCI-Datenbank heranzieht. (shrink)

Die gegenwärtig unter dem Titel ›Realismus‹ geführten Debatten in der Philosophie befinden sich nach allgemeiner Ansicht in einem Zustand größter Verwirrung, so daß es nützlich erscheint, ein wenig Ordnung in die theoretischen Optionen zu bringen bevor man für die eine oder andere Auffassung Partei ergreift. In der vorliegenden Arbeit wird dafür argumentiert, daß sich ein systematisch zusammenhängendes Zentrum dieser Debatten mit Hilfe des Begriffes der Referenz ordnen läßt. Nach der Analyse einiger klassischer Positionen soll ein Rahmen erstellt werden, innerhalb dessen (...) die Positionen eingeordnet und die zentralen Probleme fruchtbar diskutiert werden können. Zu diesem Zwecke ist es erforderlich, für die Einordnung der Positionen theoretische Kriterien zu benennen, die sich an den Problemen orientieren von denen hier argumentiert wird, das sie zentral seien. Sehr knapp ausgedrückt wird hier die Auffassung vertreten, Realismus sei als metaphysische These aufzufassen, welche eine von menschlichen epistemischen und semantischen Möglichkeiten unabhängige Existenz behauptet; in den gegenwärtigen Debatten typischerweise die Existenz einer Art von Dingen, nicht die eines individuellen Gegenstandes. Diese metaphysische These wird jedoch in der gegenwärtigen Debatte mit semantischen Argumenten untermauert, bzw. angegriffen und jene semantischen Argumente wiederum verwenden epistemische Erwägungen – die Frage betreffend, was man wissen kann und was nicht. Der Beginn der gegenwärtigen Realismusdebatten mit der soeben skizzierten zentralen Stellung semantischer Argumente ist, der hier vertretenen Auffassung zufolge, die Kritik am traditionellen Fregeschen Referenzbegriff durch Kripke und den frühen Putnam um 1970 (Kap. 2). Aus dieser neu zu bewertenden Kritik und der von den Autoren daraus entwickelten externalistischen realistischen Semantik für Artausdrücke läßt sich das erste Kriterium für eine Position in einer Realismusdebatte ableiten und klären (Kap. 3): Hält man die fragliche Art für eine natürliche Art und meint also, sie habe ihren ›Zusammenhalt‹ von Natur aus? Wenn ja, dann ist die fragliche Position eine realistische (das Kriterium ist dank des engen Zusammenhangs von Realismus und Externalismus sowohl hinreichend als auch notwendig). Hält man die Art nicht für eine natürliche Art, ist man Antirealist. Damit geht jeweils not- wendig eine bestimmte Semantik für den auf die Art referierenden Ausdruck einher. Es zeigt sich zugleich, daß es zwei Varianten des Realismus zu unterscheiden gilt, die hier als klassischer bzw. als moderater Realismus bezeichnet werden. Im folgenden (Kap. 4.1) wird argumentiert, daß der Begriff der Wahrheit nicht eigentlich der zentrale Punkt in den in Frage stehenden Realismusdebatten sein sollte, wie vielfach behauptet wurde, sondern seine Brisanz vielmehr aus zugrundeliegenden semantischen Fragen gewinnt die also in der weiteren Aufdeckung der Kriterien die zentrale Rolle spielen müssen. In der Analyse der Kritik an der in Kap. 3 entwickelten Position des ›klassischen Realismus‹ läßt sich ein zweites unterscheidendes Kriterium für Positionen in Realismusdebatten entwickeln: begriffliche Relativität. Nach der Ablehnung von Putnams Auffassungen zu diesem Thema, werden zwei Varianten vorgeschlagen, starke und schwache begriffliche Relativität (Kap. 4.2). Die Anwendung dieses Merkmals zwingt, so wird argumentiert, in einigen Fällen zu einer Kombination einer realistischen Auffassung von Arten als natürliche mit begrifflicher Relativität. Diese mittlere Position zwischen klassischem Realismus und Antirealismus wird als »moderater Realismus« bezeichnet. Der im ersten Kriterium verwendete Begriff der natürlichen Art, und damit die Optionen in den Debatten, wird schließlich mittels einer Dis- kussion des Phänomens der Vagheit noch weiter verdeutlicht (Kap. 4.3). Ab- schließend werden die drei Optionen zusammenfassend dargestellt und ein Versuch unternommen, ihre Fruchtbarkeit für diverse Realismusdebatten anzudeuten. (shrink)

Para tanto, toma-se como ponto de partida proposições apresentadas por Christopher Lasch em sua (...) obra _The Minimal Self: Psychic Survival in Troubled Times_, publicada originalmente em 1984, em particular a própria noção de mínimo eu, as quais são, então, entretecidas com argumentos de Christophe Dejours, Günther Anders, Theodor Adorno, Hebert Marcuse, Jonathan Crary, entre outros. Em acréscimo, busca-se salientar a ancoragem desses processos à hodierna dinâmica de acumulação de capital, a partir da crítica da economia política, perspectiva que atravessa todo o texto, bem como assinalar a atualidade do pensamento de Lasch. This study explored the nature of patient advocacy among 40 institutionally employed registered nurses, nurse managers, clinical nurse specialists and nursing administrators. Participants were asked to define patient advocacy, to discuss their experiences with advocacy in institutions and their perceptions of risk associated with advocacy in institutional settings, and to identify one concept central to patient advocacy. The results delineated conceptual definitions of advocacy and numerous factors that influence nurses' decisions about acting as patient advocates in institutions. Additionally, they showed (...) striking similarities between conceptual terms used to define advocacy and terms used to define caring. Cet article est basé sur une enquête auprés de quarante infirmiers/ères, directeurs/ directrices, infirmiers/ères spécialisé(e)s et administrateurs employés dans des institu tions. On a demandé aux participants de définir la défense des malades, de discuter de leurs expériences concernant cette activité dans les institutions, de leurs perceptions des risques courus au cours de la défense et d'identifier un principe central à la défense des malades. Les résultats de l'enquête présentaient des définitions conceptuels de la défense ainsi que de nombreux éléments qui influencent les décisions prises par les infirmiers/ères qui assument la défence des malades dans les institutions. En plus, les résultats montraient de grandes ressemblances entre les expressions conceptuelles utilisées pour définir cette défense et les expressions utilisées pour définir les soins. Die Beteiligten wurden gefragt, wie sie die Risiken der Fürsprache in Institutionen einschätzen, und sie wurden aufgefordert, ein allgemein gültiges Konzept für Patientenfürsprache zu identifizieren. Das Resultat zeigt begriffliche Definitionen der Fürsprache sowei verschiedene Faktoren, die die Entscheidungen des Pflegepersonals beeinflussen, wenn sie als Fürsprecher der Patienten handeln. Zugleich zeigte diese Studie auch grosse Aehnlichkeiten zwischen Begriffen der Fürsprache und der Pflege. (shrink)

Nishida Kitarō is considered by many as the most important 20th century Japanese philosopher for his ability to employ modern concepts and terminologies, and use them to construct a unique system carrying a distinctly East Asian flavour. In this system, the notion of nothingness plays a fundamental part both in terms of epistemology and ontology. While this conceptual choice was also inspired by Buddhist sources, Nishida also drew on the theoretical philosophy of Hermann Cohen to elaborate, how nothingness could function (...) as both the guarantor of unity and generator of plurality. Close analysis, however, shows that Nishida’s appropriation of Cohen’s concept of the me on as a necessary feature in the „logic of pure knowledge“ sheds the constraints carefully put in place by Cohen. As becomes evident in a comparison between both thinker’s analysis of sensation, Nishida’s unrestricted use of Cohen’s terms collapses precisely those distinctions that give sensation its meaning in the rational assessment of reality. This leaves Nishida’s concept of reality without the critical potential to distinguish between different kinds of normativity and their inter-subjective validity. Nothingness, as Nishida uses the term, is not a logical concept, but functions as an aesthetic symbol invoking sublime ideas of a perfect reality that is one and whole, and at the same time rich and diverse.Nishida Kitarō gilt vielfach als der bedeutendste japanische Philosoph des 20. Fundamental für dieses System wie für seine Apostrophierung als genuin „östlich“ war die zentrale Rolle, die er dem Nichts sowohl in logischer als auch in ontologischer Hinsicht zusprach. In der Ausarbeitung dieser systematischen Funktion machte sich Nishida Überlegungen von Hermann Cohen zur Logik der reinen Erkenntnis zueigen, die er ausweitete und aus dem Gebiet der wissenschaftlichen Erkenntnis auf andere Formen menschlichen Weltzugangs übertrug. Die genauere Analyse zeigt, dass die Inanspruchnahme Cohens problematisch ist, weil Nishida zentrale Unterscheidungen Cohens überspielt. Das Nichts, bei Cohen ein notwendiger Umweg zur Sicherung „reiner“ Begriffe, wird bei Nishida zum Quell begrifflicher Unterscheidung selbst. Die Folgen dieser Hypertrophie des Nichts zeigen sich besonders in der Behandlung der Empfindung, die bei Cohen der bloßen Anzeige des Daseins dient, bei Nishida aber sowohl Dasein als auch Realität begründen soll. Nishidas Begriff von Wirklichkeit ermangelt daher einer fundamentalen kritischen Unterscheidung und bleibt letztlich leer, was jedoch durch den durch Übernahme von systemfremden Theoriestücken geschickt erzeugten Schein einer Fülle von Wirklichkeitsbezügen verdeckt wird. Im Kern ist Nishidas Umgang mit Begriffen ästhetisch. Er bildet mit ihnen keine nachvollziehbaren Theorien, sondern erzeugt gerade mit dem Nichtsbegriff den erhabenen Schein umfassender und lebendig-vielfältiger Einheit – ein Schein, der vielleicht inspirierend wirkt, sich aber theoretisch nicht zu bewähren vermag. Vryheid is naas regverdiging een van die belangrikste temas van die Reformatoriese teologie. Luther se geskrif 'Oor die vryheid van 'n Christenmens' is een van sy hoofgeskrifte. In hierdie geskrif beskryf hy die vryheid van die innerlike en die uiterlike mens. Die innerlike mens is vry en niemand se onderdaan nie. Die uiterlike mens is weer elke ander mens se onderdaan en dienskneg. Die Christen dien sy medemens deur die liefde. Luther se verstaan van naasteliefde word vanuit ander geskrifte toegelig. (...) Johannes Calvyn se verstaan van vryheid volgens sy 'Institusie' van 1559 word ook bespreek. Daar word op die groot ooreenstemming tussen Luther en Calvyn gewys. Die verskille tussen die twee Reformatore is minimaal. Calvyn het egter wel groter aandag aan die adiafora-vraagstuk gegee. Daar word ook deurgaans na Philipp Melanchthon se invloed op Calvyn gewys. Die relevansie van die vryheidsvraagstuk lê nie in die instrumentalisering van die Christelike vryheid nie, maar in die hernude bestudering van die klassieke tekste met die bedoeling om die belangrike reformatoriese motiewe te herontdek.
